Claims Process

The following information provided is general in nature to assist you in completing your claim.

To receive Full Replacement Value, you must file your claim with the carrier within 9 months from the delivery date.

For items, which are damaged but not destroyed, the TSP will either repair the items to the extent necessary to restore them to their condition when received by the TSP, or pay the owner for the cost of such repairs. If you are claiming a large item, such as a boat or vehicle, our liability is limited to the NADA cost according to the age and other factors of depreciation

If you file your claim past 9 months from the delivery date, the TSP may depreciate the damages claimed according to the JMIDG, which is also the depreciation guide used by your base legal offices. If the owner files a claim directly with the TSP more than 9 months after the delivery date, the TSP is liable for the depreciated value of the items claimed. Liability will be as follows:

1. For items that are damaged but not destroyed, the TSP will, at its option, either repair the items to the extent necessary to restore them to their condition when received by the TSP, or pay the claimant for the cost of such repairs, up to the depreciated value of the items.

2. For items that are destroyed (i.e., the repair costs exceed the depreciated value) or lost, the TSP will pay the depreciated value for the item. However, if the claimant is willing to accept a replacement item instead of cash payment, the TSP may settle all or part of a claim by delivering a replacement item(s) of like kind, quality and condition to the claimant.

If you are not satisfied with the TSP claim settlement within 30 days, you transfer your claim to the government so that they may adjudicate it for you. You will need to fill out the DD Form 1842 to assign your claim to the Government. This form can be found by going to the following address: http://www.jag.navy.mil/documents/7%20dd1842.pdf or you can go to your appropriate base legal or transportation office. If you take your claim to the base legal office first, they may apply depreciation to your settlement offer. If you assign your claim to the government after the 9 month deadline, they will apply depreciation to your settlement.

Timely notice of loss or damage made by you is necessary to ensure that we may properly adjudicate your claim. You have up to 75 days to inspect your property and note all loss and damage discovered. If your notice is not timely, you may lose any potential recovery of your damages from either the Government or the TSP. Notice should be given electronically (on-line) to the TSP. Please note that notifying the TSP of your loss or damage is not the same as filing a claim.

The most efficient way to notify the TSP of loss or damage after delivery is to use the Department of Defense DPS system. You can access this system by going to the following web address: http://www.sddc.army.mil/EXTRACONTENT/JAY/Q1.doc.

If you have problems accessing a computer, contact your supervisor or local installation legal office for assistance. You must notify your TSP in DPS by midnight of the 75th day following delivery.

If you are unable to provide notice on-line to the TSP, you may fill out the DOD FAMILIES FIRST NOTIFICATION OF LOSS OR DAMAGE AFTER DELIVERY form. This form must be mailed (postmarked) or faxed to the TSP by midnight of the 75th day following delivery. Keep a copy of the document for your records. If more than one page is needed, include your name, PPBOL number and the number of pages on each supplemental page used. To submit a valid claim to the TSP, log-on to DPS at the following address: http://www.sddc.army.mil/EXTRACONTENT/JAY/Q1.doc and follow the instructions.

You must file your claim in this system within 9 months of your property delivery date or you will not receive "full replacement value" for eligible loss. You do not need to have repair estimates in order to enter your claim in DPS. If you choose not to file your claim in DPS, you may file your claim directly with appropriate military service, however, you will not receive "full replacement value" and will be responsible for obtaining and providing all estimates of repair. If you wish to file your claim with the Government, go to the following address: http://www.jag.navy.mil/documents/7%20dd1842.pdf and you can print out a copy of the DD Form 1842 and fill it out and present it to your base legal office.

There are exclusions from liability, which include an act or omission of the owner, defect or inherent vice of the article, hostile or warlike action, seizure or quarantine or customs regulations, delay caused by strikes, or from persons causing a disorder, acts of God (also known as acts of Nature), infestations or decontamination when not the fault of the TSP or from loss or damage that occurs prior to the release to the TSP while the goods are in the possession of a non-temporary storage (NTS) contractor, or of a storage-in-transit (SIT) contractor under an unrelated shipment.
